Decisions of the Board of Adjudication As part of the human rights complaint process, the Yukon Human Rights Commission may ask for a decision from the Human Rights Board of Adjudication, a panel independent of the Yukon Human Rights Commission.
The Commission may refer complaints to the Board of Adjudication without investigation in certain cases such as where:
- a speedy resolution is needed because of urgent circumstances; or
- there is agreement on the facts but not on how the law applies to the facts; or
- there are no witnesses to the alleged discrimination and the person who made the complaint (complainant) and the person or organization whom the complaint is against (respondent) do not agree on what happened.
If a complaint cannot be settled, or in special cases where the Commission chooses not to investigate and refers the complaint directly to the Board, there will be a hearing into the complaint before a Board of Adjudication. A panel of Adjudicators who are appointed by the Legislature and independent of the Commission will conduct a public hearing into the complaint. If the Board decides discrimination has happened or that the Act was contravened, it can make orders to stop the discrimination, to pay damages for financial loss caused by the discrimination and to pay compensation for "injury to dignity, feelings or self-respect". A decision of the Board of Adjudication can be appealed on questions of law to the Supreme Court of the Yukon. Decisions of the Board are public.
